This Personal Data Privacy Policy (hereinafter — the "Privacy Policy") applies to all information that Postwing, located at the domain name https://postwing.app, may obtain about the User while the User uses the website, programs and products of Postwing.
- Terms and definitions
- "Site Administration" — employees authorized to manage the site, acting on behalf of Postwing, who organize and (or) carry out the processing of personal data, and also determine the purposes of personal data processing, the composition of the personal data to be processed, and the actions (operations) performed with the personal data.
- "Personal data" — any information that directly or indirectly identifies a User or a User's subscriber, including but not limited to: first name, last name, date of birth, email address, gender, occupation, phone number and other demographic information.
- "Processing of personal data" — any action (operation) or set of actions (operations) performed with or without the use of automation tools on personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, modification), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion and destruction of personal data.
- "Confidentiality of personal data" — a mandatory requirement for the Operator or any other person who has obtained access to personal data not to allow its distribution without the consent of the personal data subject or another legal ground.

- Subject of the privacy policy
- This Privacy Policy establishes the obligations of the Site Administration regarding non-disclosure and protection of the confidentiality of personal data that the User provides at the request of the Site Administration when registering on the Site or when placing an order to purchase the Service.

- Purposes of collecting the user's personal information

- Determining the User's location to ensure security and prevent fraud.
- Confirming the accuracy and completeness of the personal data provided by the User.
- Creating an account for making purchases, if the User has consented to the creation of an account.
- Notifying the User of the status of an Order.
- Processing and receiving payments, confirming tax or tax benefits, disputing a payment, and determining the User's eligibility for a credit line.
- Providing the User with effective customer and technical support in case of problems related to the use of the Site.
- Providing the User, with their consent, with product updates, special offers, pricing information, newsletters and other information on behalf of Postwing or its partners.
- Carrying out advertising activities with the User's consent.
- Providing the User with access to the sites or services of Postwing's partners in order to obtain products, updates and services.
- Methods and terms of processing personal information
- The User's personal data is processed without any time limit, by any lawful means, including in personal data information systems with or without the use of automation tools.
- The User agrees that the Site Administration may transfer personal data to third parties solely for the purpose of fulfilling the User's order placed on the Postwing site.
- The User's personal data may be transferred to authorized state authorities only on the grounds and in the manner established by applicable law.
- In the event of loss or disclosure of personal data, the Site Administration informs the User of the loss or disclosure of personal data.
- The Site Administration takes the necessary organizational and technical measures to protect the User's personal information from unlawful or accidental access, destruction, modification, blocking, copying and distribution, as well as from other unlawful actions of third parties.
- The Site Administration, together with the User, takes all necessary measures to prevent losses or other negative consequences caused by the loss or disclosure of the User's personal data.
- Obligations of the parties
- The User is obliged to:
- Provide the personal data necessary to use the Site.
- Update and supplement the provided personal data in case this information changes.
- The Site Administration is obliged to:
- Use the received information solely for the purposes specified in clause 4 of this Privacy Policy.
- Keep confidential information secret, not disclose it without the User's prior written permission, and not sell, exchange, publish or otherwise disclose the User's transferred personal data, except for clauses 5.2 and 5.3 of this Privacy Policy.
- Take precautions to protect the confidentiality of the User's personal data in accordance with the procedure usually used to protect such information in existing business practice.
- Block the personal data relating to the relevant User from the moment of the request of the User or their legal representative or the authorized body for the protection of the rights of personal data subjects for the period of verification, in case of detection of inaccurate personal data or unlawful actions.
- Liability of the parties
- The Site Administration, having failed to fulfill its obligations, is liable for losses incurred by the User in connection with the unlawful use of personal data, in accordance with applicable law, except for the cases provided for in clauses 5.2, 5.3 and 7.2 of this Privacy Policy.
- In the event of loss or disclosure of Confidential information, the Site Administration is not liable if such confidential information:
- Became public property before its loss or disclosure.
- Was received from a third party before it was received by the Site Administration.
- Was disclosed with the User's consent.
- Dispute resolution
- Before filing a lawsuit in disputes arising from the relationship between the User and the Site Administration, it is mandatory to submit a claim (a written proposal for the voluntary settlement of the dispute).
- The recipient of the claim, within 30 calendar days from the date of receipt of the claim, notifies the claimant in writing of the results of the consideration of the claim.
- If no agreement is reached, the dispute will be referred to a judicial body in accordance with applicable law.
- Applicable law governs this Privacy Policy and the relationship between the User and the Site Administration.
- Additional terms
- The Site Administration has the right to make changes to this Privacy Policy without the User's consent.
- The new Privacy Policy takes effect from the moment it is posted on the Postwing site, unless otherwise provided by the new version of the Privacy Policy.
